The safety of both parties involved must be taken into consideration in the process. The first thing that must be examined is the safety of society. The refugee determination process which exists in Canada prevents migrants with a past criminal history from being granted refugee status. Many believe however that the determination process is inadequate as it is backlogged with thousand of refugee claims meaning that a possibly dangerous migrant awaiting a determination hearing would be allowed to reside in Canada until that time.

Also existing with the determination process in an Undocumented Convention Class which allows refugees whose identity documents are unable to be obtained to do civil war in their country to be admitted into Canada. In addressing the safety concern involved in the determination process one of the bills main goals as stated in s section (J) of the bill summary was to enforce the ineligibility of foreign nationals who are criminals, security threats, and repeat claimants to the refugee protection process of the Immigration and Refugee Board. This will ensure that bogus claimants are both not granted refugee status and not eligible to continuously file claims with the intention of prolonging their stay in Canada. Those favoring the humanitarian policy of Canada states that economically the individuals admitted will actually benefit Canada economically.

The debate has once again been settled to some extent and a compromise has been formed in the passing of Bill C- 31. The bill brings with it improvements to the refugee determination process and by not allowing repeat claimants to continuously file the system will move quicker and those of whom are not granted refugee status will be sent back to their country and will no longer be a responsibility to tax payers. 336
