Arizona was an appeal from the conviction for kidnapping and rape. The accused Ernesto Miranda was arrested, questioned by the police officers, signed a confession, and was convicted of attempted rape, kidnapping and robbery. The officers claimed his confession was made voluntarily and Miranda had full knowledge of his legal rights. As the case went to trial, Miranda's written confession was used against him as the evidence. Miranda was convicted and sentenced to twenty to thirty years of imprisonment on each charge, with the sentences running concurrently. Alvin Moore, the court-appointed lawyer appealed to the Arizona Supreme Court and claimed that Miranda didn't request counsel.

The legal issue was whether the law enforcement officials need to inform the accused person of his rights, and whether the statements and evidence, which was obtained from the person subjected to custodial police interrogation are admissible in case the accused individual wasnt notified about his right under the 5 th Amendment not to tell facts to incriminate himself. Chief Justice Earl Warren told that Miranda had never been told in any form of his right to council, or his right to have one during his questioning. The Supreme Court claimed that the statement from the accused were inadmissible without these warnings and reversed the decision. The dissenting justices claimed that in case the accused persons are informed of their rights, they would always deny the ability of the police to seek confessions and would always demand attorneys. I agree with the decision made by the Supreme Court, because it is very important to allow the convicted person to enjoy his rights in order to protect the innocent individuals from undue hardships.
