Dr. Martin Luther King, Jr. believed civil disobedience, when enacted for the correct reasons, was a useful tool to fight unjust laws. Dr. King gives guidelines and criteria for deciding if a law is just or unjust. The guidelines that I will discuss were created by Dr.

King to help him decide whether a law is just or unjust and to then justify his reasoning against objections. If Dr. King, through his guidelines, found a law to be just, he believed that a display of civil disobedience against the law would be wrong. But, if Dr.

King found a law to be unjust, then civil disobedience would be correct and morally right. As you can see, Dr. Kings guidelines to determine if a law is just or unjust was an integral part of his views on civil disobedience. In fact, his guidelines were the basis of his argument for civil disobedience (King 539). In defining the definition between just and unjust laws, Dr. King first gives his definition of what just and unjust laws are.

Dr. King says that a just law is that law that aligns with the moral law or the law of God. On the other hand, an unjust law is that law that is not aligned with the moral law (King 539). King believed that any law that did not agree with the law of God was unjust. For many, the definition of Gods law has many different meanings, but Dr. King being a Baptist minister, believed the definition of Gods law to be any law that does not contradict or undermine the teachings in the Bible.

If any law contradicts the Bible, then Dr. King would judge that law to be unjust. Dr. King also believed that any law that uplifts human personality was just and any law that degrades human personality was unjust.

He used this argument to explain why segregation was an unjust law. He states that segregation damages the soul of that one segregated against, thus making it an unjust law. Dr. King, quoting Martin Buber, writes, [segregation] substitutes an I-it relationship for an I-thou relationship.

This I-it relationship views the personality of a human as a thing, and not as a human soul. This objectivity of a human soul is unjust because it degrades the personality of a human (King 539). Another guideline Dr. King held to determine justice is that any [unjust] separation of humans is a sin. In the first guideline, King states that anything that does not align with Gods law is unjust. Sin does not line up with Gods law and separation is a sin, therefore laws concerning separation of two classes of humans are unjust.

This guideline allowed King to justify the Supreme Court decision to end segregation and to not obey laws that enforced segregation. This guideline also allows Dr. King to address the issue that the laws that a majority enforces on the minority and does not enforce on themselves are unjust. King claims this difference in accountability of the law is unjust. This guideline also helps King to claim that segregation was unjust, for many laws were enacted on the minority that the majority did not follow themselves (King 539).

All of the guidelines aforementioned were the basis of Dr. Kings argument for civil disobedience. If Dr. King did not make these distinctions between a just and unjust law, then he himself would be nothing more than a simple criminal breaking laws, but since he makes these distinctions and justifies the right to defy unjust laws, the act of maliciously breaking the law is converted to civil disobedience.

Mahatma Gandhi, an Indian leader and activist of civil disobedience, does not make the same concrete distinctions of just and unjust laws as Dr. King does. Gandhi believed that the state, or the general population, was a cause for some of the unjust ideas during his time. He believed that if every man would purify his own self, then the disease, or unjust ideas, of the land would disappear (Gandhi 205). Gandhi also believed the central government was a source of unjust laws. He believed that if the government makes laws and subjects everyone to these laws under no circumstances, then that constitutes slavery, which is an unjust thing (Gandhi 205).

Gandhi does mirror King in this idea. King also believed that the majority that puts restrains on the minority is an unjust majority. Gandhi does not make definite line of what is just and unjust, but he gives guidelines on how one should live their life and conduct their daily affairs. Gandhi's ideas deal more with the self-purification of every man in order to cure the problem. Gandhi does not necessarily give reasons, but cures and solutions for the problem of unjust ideas, unlike King who gave reasons and guidelines to determine whether a law is just or unjust.
