Murder! Rape! Terrorism! Most consider the people that commit these heinous crimes, but some say these people deserve a second chance. The debate over the merits of capital punishment has endured for years, and continues to be an extremely complicated issue. Adversaries of capital punishment point to the Marshalls and the Milliards, while proponents point to the Dahmers and Games.

Capital punishment is the legal infliction of the death penalty on persons convicted of a crime (Cox). It is not intended to inflict any physical pain or any torture; it is only another form of punishment. It is irrevocable because it removes those punished from society permanently, instead of temporarily imprisoning them. The usual alternative to the death penalty is life-long imprisonment.

Capital punishment is a method of retributive punishment as old as civilization itself. The death penalty has been imposed throughout history for many crimes, ranging from blasphemy and treason to petty theft and murder. Although there is no punishment that can entirely eliminate violent crime, a more stringent use of the death penalty would significantly help. Those who are for the death penalty argue the following points: Last October, Louisiana executed a man named Ernest Knighton. Knighton had killed a gas station owner during a robbery. Like any murder this was a terrible crime. But it was not premeditated, and is the sort of crime that very rarely results in a death sentence.

Most convicted murderers and their lawyers plead for life instead of the death penalty. If they were tough enough to rape a little kid they should be tough enough to take the punishment?

Those who oppose capital punishment bring to light the following arguments. When committing a serious crime does it occur to the criminal that, if caught, he / she could be electrocuted, gassed, or lethally injected? I highly doubt it. So why do people who support the capital punishment call it a deterrent? The death penalty violates constitutional prohibitions against cruel and unusual punishment. Although murderers come from all classes, those on death row are almost without exception poor and were living in poverty at the they were arrested.

Capital punishment discriminates against the poor. The majority of death row inmates are represented by court appointed public defenders- and the state is not obligated to provide an attorney at all for appeals beyond the state level. Our criminal justice system is very flawed. For example Roosevelt Green was executed in Georgia two days before J. C.

Shaw. Green and an accomplice kidnapped a young woman. Green swore that his companion shot her to death after Green had left, and that he knew nothing about the murder. Green s claim was supported by a statement that his accomplice made to a witness after the crime. The jury never resolved whether Green was telling the truth, and when he tried to take a polygraph examination a few days before his scheduled execution, the state refused to allow the examiner into the prison (Bruck, 1985, P. 482) That is just one case. The criminal Justice system is so overworked no one really knows how many innocent people are on death row.

According to that same website 89 innocent men have been sentenced to death in the last 20 years. If the Criminal Justice system was not flawed why would the following be introduced Senator Russ Feingold (D-WI), and Representative Jesse Jackson Jr. (D-IL). have introduced legislation in the Senate and House calling for a moratorium on all executions while a blue-ribbon task force reviews the system of capital punishment in America. Senator Feingold has also introduced legislation to abolish the Federal Death penalty.

Sen. Leahy (D-VT) has introduced legislation requiring DNA testing to be made available to all inmates who have a claim of innocence. (Deathpenalty. org). Certainly advocates for the abolishment of the death penalty have valid concerns. Reforms are needed to the criminal Justice system to ensure that a level playing field is established. The majority of minorities use public defenders.

Statistics dont lie public defenders are over worked and underpaid. If we want Society must be kept safe from the monstrous barbaric acts of these individuals and the only way to guaranty they dont strike again is to take there life. The death penalty will never be fool proof but if reforms are made it will be close to it.
