We the Affirmative believe the United States Military s Don t Ask, Don t Tell policy should be repealed. We argue that homosexuals are not a threat to the military, that the policy is a hardship on American taxpayers, and that the policy is not being administered properly and never has been. People are different. People have always been different; this isn t a new concept. There are differences ranging from physical appearance to political opinion to sexual orientation. Our society has consistently been confronted with and has consistently overcome those differences that may be a threat to human cohesion.

Cohesion is an important term, used often in this debate. Webster s Dictionary defines cohesion as The act or state of sticking together; close union. Proponents of the United States Military s Don t Ask, Don t Tell policy frequently argue that homosexuals in the military are a threat to unit cohesion and morale, that the military is a much different society than what the average citizen lives in. Meaning that a heterosexual service member would have trouble serving with a homosexual one, and that despite growing acceptance of homosexuals in the workplace, school, and in general everyday life; the military is a different society than the world as we know it, and not as accepting. However, if you ask any Professor of Political Science they will all tell you what Dr. Roger Payne told me; that the military is supposed to represent the ideals of our culture.

Since the invention of the military, it has been a common belief that unit cohesion is a necessity to the successful operation of any military force. We argue that homosexual service members, who have not tried to hide their sexual orientation, are in actuality not a threat to unit cohesion. Over one hundred years ago African Americans began to serve their country in the military despite beliefs from fellow white servicemen that they were inferior, and not capable of successfully performing the same tasks as white servicemen. The addition of African Americans to the United States Military was a large threat to unit cohesion.

As years went by the military searched for a way to allow African Americans to serve in the armed forces without compromising unit cohesion. The government decided to segregate the military, which they did. African Americans could now serve in the military with less racial tension, and with less harassment from white servicemen. During this period of segregation, servicemen were trained in the same manner, learned the same information, and lived by the same set of rules.

Racial identity became less important. Then on July 26, 1948 President Harry S. Truman issued Executive Order # 9981. This order was a direct mandate from the President of the United States, also Commander in Chief of the United States Armed Services. The executive order stated It is hereby declared to be the policy of the President that there shall be equality of treatment and opportunity for all persons in the armed services without regard to race, color, religion or national origin.

This policy shall be put into effect as rapidly as possible, having due regard to the time required to effectuate any necessary changes without impairing efficiency or morale. Ever since President Truman issued this order, our country has had a strong de-segregated military without the loss of unit cohesion or morale. This integration took only six years. The current policy has had seven years and has not been effective. The policy has had due time. It simply doesn t work.

Then several years after Truman s Executive Order, another large threat to unit cohesion and morale surfaced. Women wanted equal opportunity to serve in the military in combat positions. Women were allowed to serve in the military, though they are segregated from men. Women are also restricted from serving in combat other than a support position. However many believe that after being trained separately from men, and now being trained alongside men, women will soon serve alongside men in combat. We propose that Homosexuals be integrated into the military in the same manner as African Americans and Women.

It is very possible to have gays in the military without jeopardizing morale or cohesion. Every other nation in NATO with a military, with the exception of Turkey, allows homosexuals to openly serve in the armed forces. Why can t America? The Don t Ask, Don t Tell policy has cost taxpayer s over 160 million dollars over a six year period.

That is enough money to send 23, 200 people to this University for four years, and buy them parking permits. A large part of the problem with the Don t Ask, Don t Tell policy is the way it is administered. You will here the Negative side themselves admit to this. In a 1998 report commissioned by the Secretary of Defense, it was found, and I quote: that the number of service members discharged for homosexual conduct has in fact risen since the new policy became effective in 1994. We believe that this increase is cause for some concern. Witch-hunts are being carried out by military officials to root out homosexual servicemen.

Health care providers such as Doctors and Therapists are being prompted by the military to release information about their patient s sexual orientation in the hopes of discharging more homosexuals. Servicemen facing jail time have been offered plea bargains to out homosexual servicemen. Something the SLDN (Service member s Legal Defense Network) says strongly violates the Don t Ask, Don t Tell policy which states that officers may not inquire about a serviceman s sexual orientation. The SLDN has found that members of the Naval Criminal Investigative Service have been conducting undercover surveillance in Gay bars and clubs in an effort to spot homosexual service members, another serious policy violation. In fact according to the SLDN, anti-gay harassment increased 120 percent in 1998 alone. The policy has encouraged this harassment by failing to properly respond to and investigate harassment claims.

Sailor Allen Schindler was brutally murdered by two fellow sailors. One of them only served three months of jail time, yet Schindler was so badly beaten that the Navy pathologist described his injuries as more consistent with a high-speed automobile accident or low-speed airplane crash. Schindler's liver contained holes that allowed him (the pathologist) to see straight through it. Private First Class Barry Wenchell served in Fort Campbell Kentucky. Private Wenchell was sound asleep in his bed during the early hours of July 5, 1999. Private Wenchell was attacked in his sleep, and bludgeoned to death with a baseball bat.

The murder occurred on the 3 rd floor of a Fort Campbell barracks. Some soldiers believed Barry Wenchell was gay, but had no proof. In fact, Sgt. Michael Kleifgen asked Private Wenchell if he was gay, a direct violation of the Don t Ask, Don t Tell policy. Wenchell replied that, no, he wasn t gay. Private Wenchell was murdered by a soldier living in his barracks, one who admitted to harassing Wenchell on a daily basis and taunted Wenchell for being a homosexual despite no evidence to that effect.

In an email being investigated by the Army, Lt Col. Edward Melton referred to Private Wenchell s death. The email reads: Due to the hate crime death of a homo in the Army, we now have to take extra steps to ensure the safety of the queer who has told (not kept his part of the DOD dont ask, dont tell policy). Commanders now bear responsibility if someone decides to assault the young backside ranger. Be discreet and careful in your dealings with these characters. And remember, little ears are everywhere.

Some of you may be wondering why I haven t brought up the constitution. The Negative team may try to infer that every lawyer who has ever stood in a courtroom and argued that this policy is unconstitutional has lost. But that would not be the truth. In fact the policy has been ruled unconstitutional several times. On July 2 nd, 1997 a Federal Court Judge ruled the policy unconstitutional, re-affirming the verdict returned two years prior, when the policy was ruled unconstitutional in 1995. Unfortunately these cases have been kept in appeal for many years as policy proponents try to protect themselves from judicial rulings.

It is obvious that the current policy should be repealed. If no one understands the rules, if no one follows the rules, if no one enforces the rules, why have the rules?
