To Lie or not to Lie, Doctors Ethical Dilemma Doctors often face a critical issue of whether or not to tell the truth about the patients physical state. This is an ethical dilemma that we are going to address in this research. In my personal opinion it is good to always be honest in relationship to anybody. This way it is easier to avoid misconceptions and misunderstandings between people. Doctors are to be honest with their patients in most of the cases of their practice.

According to the article there are some cases when doctors may hide the truth and those are the cases of very severe disease when a patient has no choice to live much longer. In order to understand this issue in some depth we may bring here a parallel with the relationships between the employer and the employee. The moral dilemma exists between employer and worker, and morality is seen as an essential factor which presents itself as contributing to this dilemma. As indicated in the beginning of this term paper, it has taken labor many decades to arrive at the point which the American worker has arrived at in the late 1990 s and the impending 21 st century.

Yet, I also believe that it would be fair to state that this attrition between employer and worker has been in situ for a long time, and still, final resolutions have yet to be made at this time. There must be a shared degree of understanding in terms of ethics by and for both management and worker. Similarly, there must be a sense of shared agreement as to what constitutes ethics, or ethical theory. The great thinkers such as Immanuel Kant, John Locke, and many more have contributed to our understanding of this dilemma, as well as a possible redemption. It is best understood in terms of a social contract. Another way to look at the issue at hand is from a States perspective.

In Minnesota, The Striker Replacement Law was upheld in the State Court. An employer sued a union in order to determine whether or not the hiring of replacement workers in North Dakota violated the Minnesota picket line, and whether the acts violated the Federal Constitution by infringing upon Federal labor Law. While Federal Labor Law generally preempts state and local labor regulations, the Court holds Minnesota can prohibit the hiring of permanent replacement workers in order to advance legitimate interest in preventing violence and promoting the peaceful settlement of labor disputes. This incident, to me, represents the intricacies of the law. In the case of Minnesota, we see where there exists a specific preempting of predefined acts within overriding laws and the subsequent decisions by state laws.

This explanation, granted, is within its simplest form, yet underscores the complexities of the law. On a federal level, the legal variables assume much greater complexity. The vote to ban striker replacements is arguably one of the most significant pieces of legislation within the history of labor. Since its presentation, there have been issues raised on both sides of the argument, as well as many of the related legal and management-related vagaries which have been raised with increased complexity.
