Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof, or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. This is what the first amendment of The Constitution of the United States promises to every American citizen. The first amendment is what gives us the opportunity to practice whatever religion we would like and not be tortured or harassed for it, the right to speak our mind freely and not be punished for it, the ability to meet with others and express all of the thoughts that we have, and the right to petition against ideas that we do not agree with and would like to change. On December 15, 1791 the Bill of Rights was ratified and became a very important part of the Constitution as we know it. Before the Bill of Rights, which includes the 1 st amendment, we were not promised all of the things that we are promised today such as the freedom of speech, religion and assembly. Without the 1 st amendment and the Bill of Rights, we would not be living the lives we live today.

The freedom of speech and press was provided to us to protect the expression of unpopular views, to allow people to have their say and not be punished for it. Although the freedom of speech is still somewhat bridled, it does give Americans the ability to say or write pretty much whatever they want. For example, while one can criticize our government, they do not have the right to slander another person. In one case, there is a Minnesota law that limits what state judicial candidates can say during election campaigns about issues that may come before them while on the bench.

Although the Supreme court agreed with this, it is a very controversial rule. It seems here that the First amendment is being challenged. (see works cited) The freedom of religion was instituted so that any and all Americans could have their own religious beliefs without being persecuted. A large number of early colonists moved to America to get away from the religious persecution they were suffering in their own countries. Just like the freedom of speech and press though, there are limitations on the freedom of religion. One of the largest limitations on this freedom is the Establishment Clause. The Establishment Clause sets up, a wall of separation between church and state, as said by Thomas Jefferson.

It is this clause that finds it unconstitutional for such things as the posting of the ten commandments in public classrooms (Stone vs. Graham, 1980), a moment of silence to begin the school day (Wallace vs. Jaffre, 1985), and prayer in public school graduations (Lee vs. Weisman, 1992).

Basically we can say that the Establishment Clause was set up that no religion is forced upon any citizen, therefore preserving his freedom of religious beliefs or disbelief's for that matter. The freedom of assembly and petition guarantees the right of the people peaceably to assemble, and to petition government for a redress of grievances. Like the rest of our rights this one too, is limited. The limitations come with the word peaceably and with the fact that there is fine line between private and public areas. In a case that occurred in the West Des Moines shopping mall, the high court declared it unlawful for protestors to meet there and protest.

In this case, it was decided that the mall was privately owned and that after being asked to leave, the protestors should have added. After not abiding, the protestors were arrested and charged with trespassing. (see works cited) We must also look at the other side of this right though. Americans are given so much say with this right. We have the ability to go to Capitol Hill, to presidential speeches, to all sorts of functions and just say No! I disagree! . This is an amazing right that we have, that so many others are not granted elsewhere.

In conclusion, the 1 st amendment is a right granted to all Americans which protects, enables and allows. It protects us from torture and harassment, no matter what we believe in religiously. It enables us to say what we feel when we feel. It allows us to petition and to assemble, if we want to support or disagree with others views. We are so lucky to have these rights and we can not take them for granted. We must also realize the limitations on these rights.

We must remember the Establishment Clause, and the meaning of the word peaceably. Our government has respected us as a society and given us these rights, and we must respect our partners in society and recognize our limitations. Without the 1 st amendment, the United States would not be the land of the free and it would not be a safe haven for so many who come to escape persecution from their governments and fellow citizens. To sum it all up, we should look to the words of Justice Robert H.

Jackson: If there is any fixed star in our constitutional constellation, it is that no official, high or petty, can prescribe what shall be orthodox in politics, nationalism, religion, or any other matter of opinion or force citizens to confess by word or act their faith therein.
