... gators. But although it might seem that finding a way to define whats right and whats wrong is a solution to pre-emptive strikes and war, it ultimately raises more problems than it solves. The biggest problem we find is that principles in the Charter of the United Nations seem to contradict each other.

The first core principle in the treaty of Westphalia, and one of the principles in the Charter of the United Nations, is rex est imperator in regno suo, which basically means the leader of a country shall be sovereign and be able to do as he pleases in his own boundaries, without the interference of outside influences (Griffiths, M and Ocallaghan, T. 2002). Therefore to interfere with other countries issues is going against the laws of international order and the modern state system. But in 1948 the UN released a Universal Declaration of Human Rights, which formalizes what every human on this planet is entitled to. Some of these rights include; No one shall be held in slavery or servitude; slavery and the slave trade shall be prohibited in all their forms, Everyone has the right to life, liberty and security of person, and No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment (General Assembly resolution 217 A (III). 1948). Therefore when using the US strikes on Iraq as an example we find a stark contradiction in the state system and declaration of Human Rights. Saddam Hussein violated the Declaration of Human Rights through his dictatorship and treatment of his people.

Yes, this calls for UN intervention. But for the US to come in and invade Iraq to free the people is also a violation of the Charter of the United Nations. By law what Saddam Hussein does in his own country is his own business. We can see the contradiction and the sticky spot that it puts the UN in when making these laws. The UN is currently recommending the first reform in its 60 year history.

This reform is set to back the use of pre-emptive strikes (Penketh, A. 2004). This is highly debatable and raises issues such as whether the UN is merely bowing down to a superpower named the USA. While the US condemned pre-emptive strikes such as Israels bombing of the nuclear reactor and Japans strike on Pearl Harbor, it is ok for them to invade Iraq and, taking the current situation to thought, Iran. Taking a different point of view on the topic, what if a country like Russia, or China didnt feel that the US government was doing enough to stop their poverty crisis (Cohn, D. 2000) and hence was an oppressive government not giving its people the rights they deserve.

Would that be any different to the US picture of Iraq? Would that warrant an invasion? As Griffith (2003) pg 142, 143, points out, the Human Rights set out by the UN is merely a western concept of how the world should run, and with the US being the dominant power in the west, they might as well write the rules. The US can arguably do what they want when it comes to foreign affairs. Take the war in Iraq, France strongly opposed a US invasion, and France have the power of VETO (United Nations. 2005), therefore the invasion was not allowed to happen.

But it did, and the US was not punished for its violations. The UN needs to set a precedent of dealing with pre-emptive strikes. Without a precedent, international order is chaos. In this world we cannot have different sets of rules for different situations or wars will not end, to the point where we will be destroyed. The reformation of the UN is not a start.

Making a new set of rules to cope with US hegemony is not solving any issues. A start to a proper international order would be to define defence and threat in a manner clear to all parties. Total prevention of killing will never happen, but it can be limited by countries knowing when exactly they can defend themselves and in what manner, and the harsh consequences that will be sanctioned on them if violated. So when the big bully at school comes over to hit you, is it ok to him first? Yes, but is it ok to go over and hit the bully just because you think he is going to hit you? No!

Until this differentiation is recognized by the major bodies of this world, and set out in policies with harsh punishments, there will always be this grey area in between right and wrong. We cannot stop people hitting each other, that is just wishful thinking, but we can take the steps towards only hitting when it is absolutely necessary due to an iron clad threat coming towards us.
